Scope
These Terms and Conditions of Sale apply to all orders placed on the website www.obscura-sancta.com .
They govern the contractual relationship between Obscura Sancta, a sole proprietorship registered with the Trade and Companies Register / Crafts Register of Rennes - France under number 944 513 035, and any individual or legal entity purchasing through the website.
Products
Obscura Sancta offers unique handcrafted creations made from antique and/or natural objects. Each product is presented with a detailed description and photographs.
As most items are antique or handmade, slight variations may exist compared to the photos. These are not considered defects but rather proof of the authenticity and uniqueness of each piece.
Specific Clause : Regulated Products and Ethics
The sale of bladed weapons (knives, daggers, etc.) and related items is strictly prohibited to minors.
Obscura Sancta complies with French legislation regarding the commercialization and possession of such products. Any order placed in violation of these provisions may be cancelled.
In the event that a minor provides false information in order to purchase a regulated product, Obscura Sancta cannot be held responsible for the user’s behavior. Any violation remains the sole responsibility of the offender and may result in legal proceedings under French law.
Concerning animals and insects used in certain creations:
- No protected species, prohibited items, or specimens subject to international conventions (e.g. CITES) are sold.
- All bones, feathers, or insects used come from environmentally responsible sources (naturally deceased animals, careful collection) and in compliance with applicable legal regulations.
- No animal or insect is killed, captured, or mistreated in the course of our creative process.
Specific Clause : Environmental Compliance and Chemical Waste Management
In the context of repurposing (or creation including :) antique objects, certain products (solvents, varnishes, treatment agents, etc.) may be used.
Obscura Sancta undertakes to:
- use these products responsibly and in accordance with applicable standards,
- ensure their disposal and recycling through approved channels (e.g. specialized waste facilities),
- minimize the environmental impact of its artisanal processes as much as possible.
Specific Clause : Esoteric-Themed Products
Some products offered by Obscura Sancta may draw inspiration from religious, spiritual, or esoteric traditions (e.g. Christianity, paganism, wicca, witchcraft, etc.).
These references are used solely within a cultural, historical, artisanal, or decorative context..
Obscura Sancta expressly states that:
- its products do not represent any ideology, religious practice, or act of proselytism,,
- they are not intended to promote or propagate any particular belief,
- they are intended exclusively for decorative, artistic, symbolic, or collectible purposes.
Prices
Product prices are indicated in euros (€), inclusive of all taxes (VAT included).
Shipping costs are specified during the ordering process and added to the total before validation.
Obscura Sancta reserves the right to modify its prices at any time, but products will be billed based on the rates in effect at the time of order.
Orders
Placing an order implies full acceptance of these Terms and Conditions of Sale.
The customer will receive an email confirming the order details.
Obscura Sancta reserves the right to refuse or cancel any order in case of an existing dispute with the customer (non-payment, fraud, etc.).
Payment
Payment is due immediately upon ordering.
Payments may be made via credit card or PayPal.
All transactions are secured through WooCommerce extension.
Delivery
Products are shipped to the delivery address provided by the customer.
Indicative shipping time: 2 to 5 business days after the order is confirmed.
Available delivery methods : Colissimo and Mondial Relay (depending on the destination country).
Obscura Sancta cannot be held responsible for delays attributable to carriers.
Specific Clause : Carrier Damage Liability
Special care is taken in preparing and protecting each order. However, once the parcel has been handed over to the carrier, any damage or breakage becomes the responsibility of the carrier.
In the event of a damaged parcel, customers are strongly advised to refuse delivery and take photographs of the package in the presence of the courier..
The customer may then pursue recourse with the carrier, including:
- filing an official claim with the carrier’s customer service,
- requesting compensation as provided under the carrier’s terms and conditions.
Obscura Sancta will assist the customer in these steps as far as possible but cannot substitute itself for the carrier’s legal responsibility.
Right of Withdrawal
In accordance with Article L.221-18 of the French Consumer Code, the buyer has 14 days from receipt of the order to exercise the right of withdrawal, without having to justify any reason or pay penalties.
Exceptions : Certain items are not subject to the right of withdrawal, including but not limited to:
- personalized or custom-made products
Returned products must be in perfect condition, in their original packaging, and returned at the customer’s expense. Refunds will be issued within 14 days of receiving the returned items.
Additional Return Policy
Beyond the statutory right of withdrawal, Obscura Sancta may exceptionally accept returns within 21 days of receipt, provided that:
- the product is in perfect condition,
- it is returned in its original packaging.
In this case, Obscura Sancta offers :
- an store credit, or
- an exchange valid on the shop, for a period of 12 months from the date the credit is issued.
Reservation clause
Obscura Sancta reserves the right to refuse a return request if the product description and presentation were sufficiently clear and could not reasonably lead to confusion on the part of the buyer.
Legal Warranties
All products are covered by the legal warranty of conformity (Articles L.217-3 and following of the French Consumer Code) and the warranty against hidden defects (Articles 1641 and following of the French Civil Code).
In the event of a non-conforming or defective product, the customer may contact Obscura Sancta at obscura-sancta@outlook.com to request an exchange or refund (after the product is returned).
Liability
Obscura Sancta cannot be held liable for misuse, normal wear and tear, negligence, or lack of maintenance by the customer.
Obscura Sancta shall not be held responsible for indirect damages related to the use of the products.
Personal Data
Data collected during the ordering process is necessary for managing purchases and customer relations.
They are processed in accordance with our privacy policy and GDPR regulations.
The customer has the right to access, rectify, and delete their data (see Legal Notice).
Governing Law
These Terms and Conditions of Sale are governed by French law.
In the event of a dispute, French courts shall have exclusive jurisdiction.
